Liability Waiver & Release
Important: By signing this waiver, you are giving up certain legal rights, on your own behalf and on behalf of your child, including the right to sue for injuries or damages. Read fully before agreeing.
1. Parent/Guardian Authority
I, the undersigned Parent/Guardian, represent that I am the parent or legal guardian of the Athlete named on the intake form, that the Athlete is under 18 years of age, and that I have the legal authority to sign this waiver on the Athlete's behalf. I give my permission for the Athlete to participate in a training program provided by Ndur.
2. Assumption of Risk
I acknowledge and understand that marathon training and distance running involve inherent risks to the Athlete, including but not limited to:
- Musculoskeletal injuries including strains, sprains, stress fractures, growth-plate injuries, and overuse injuries
- Cardiovascular events including abnormal heart rhythms and, in rare cases, cardiac arrest
- Heat-related illness, dehydration, and hyponatremia
- Falls, accidents, and injuries caused by road, trail, traffic, or weather conditions
- Psychological stress associated with high-volume training
On my own behalf and on behalf of the Athlete, I voluntarily assume all such risks, whether known or unknown, and accept full responsibility for any injury, illness, or loss that may result from the Athlete's participation in a training program provided by Ndur.
3. Medical Clearance
I confirm that the Athlete has been examined by, or will be examined by, a licensed physician prior to beginning this training program. I represent that the Athlete is in suitable physical condition to undertake distance running training and that I am not aware of any medical condition that would make participation inadvisable. I agree to immediately notify Ndur and seek medical attention for the Athlete if they experience any unusual symptoms during training.
4. Supervision
I understand that Ndur provides remote coaching only and does not supervise the Athlete's workouts in person. I accept responsibility for deciding where, when, and with what supervision the Athlete trains.
5. Release of Liability
In consideration of Ndur providing coaching services to the Athlete, I, on my own behalf and on behalf of the Athlete, hereby release, waive, discharge, and covenant not to sue Ndur, its owners, coaches, employees, agents, and affiliates (collectively, "Released Parties") from any and all claims, demands, damages, rights of action, or causes of action arising from:
- The Athlete's participation in any training activities prescribed or recommended by Ndur
- Any injury, illness, death, or property damage resulting from such participation
- The negligence of the Released Parties, to the fullest extent permitted by law
6. Indemnification
I agree to indemnify and hold harmless the Released Parties from any loss, liability, damage, or cost they may incur arising out of or related to the Athlete's participation in training activities, including any claim brought by or on behalf of the Athlete, and including reasonable attorneys' fees.
7. Emergency Medical Authorization
In the event of an emergency where I cannot be reached, I authorize Ndur to seek emergency medical assistance for the Athlete, and I consent to emergency medical treatment the attending medical professionals consider necessary. I agree to be responsible for all costs associated with such medical care.
8. Acknowledgment of Independent Judgment
I acknowledge that the Athlete, and I as their Parent/Guardian, are free to modify, reduce, or stop any prescribed training at any time based on the Athlete's physical condition and our judgment. Ndur's training recommendations are guidance only, and the Athlete and I retain responsibility for decisions about the Athlete's training.
9. Severability
If any provision of this waiver is found to be unenforceable, the remaining provisions shall remain in full force and effect.
10. Voluntary Agreement
I have read this Liability Waiver and Release in its entirety, I understand its contents, and I sign it voluntarily and of my own free will, on my own behalf and on behalf of the Athlete. I am at least 18 years of age. I have discussed the risks of training with the Athlete.
Accepted electronically when the Parent/Guardian checks the agreement box and submits the Ndur intake form on the Athlete's behalf. The Parent/Guardian's name and the date of acceptance are recorded with the Athlete's profile.
